Limitation of Liability

All orders placed through the order entry system are taken on a best efforts basis. The Coin Hunter Inc. shall not be responsible for errors, negligence or inability to execute orders. Nor shall The Coin Hunter Inc. responsible for any delays in the transmission, delivery or execution of customer’s order due to breakdown or failure of transmission or communication facilities, or to any other cause or causes beyond The Coin Hunter Inc. reasonable control or anticipation.

Our order entry systems have been designed to provide an efficient and dependable method for entering orders. Commercial internet service providers are not 100% reliable and a failure by one or more of these providers may affect internet based order entry. The customer acknowledges that the order entry system is a mechanical system and as such may be subject to failure beyond the control of The Coin Hunter Inc.. The customer acknowledges having read and understands the order entry system risk disclosure and disclaimer.

Risks

All investments involve risk – coins and bullion are no exception. The value of a bullion is affected by many economic factors, including the current market price of bullion and the perceived scarcity and other factors. Some of these factors include the quality and current demand and general market sentiment. The purchase and sale of Precious Metals provides no guarantee of interest, yield or return. Losses may be incurred both as a result of price devaluation and if price gains do not exceed applicable fees, including those charged herein.  The Customer has read and understands these Terms and Conditions and acknowledges that all risk of decline in the market value of any Precious Metals is the Customer’s risk and not that of The Coin Hunter Inc..  Therefore, because both bullion and coins can go down as well as up in value, investing in them may not be suitable for everyone. Since all investments, including bullion and coins, can decline in value, you should understand them well, and have adequate cash reserves and disposable income before considering a bullion or coin investment. If the Customer has any doubt as to the suitability of Precious Metals as an investment, the Customer should contact an independent legal or financial advisor.

Market Volatility & Payment

Once you have placed an order to buy with The Coin Hunter Inc., you have entered into a binding agreement.

When ordering online, the price at which your order is submitted is the locked-in price. Your confirmation number will be in your return email.

The parties hereto agree that the bullion products we offer for sale are commodities traded on various markets, and that the market price and availability of such bullion change constantly in accordance with market forces and supply and demand. We reserve the sole and absolute discretion to set the sale and buy-back prices for all products and bullion offered by us.

Once you’ve placed your order, we do NOT allow any cancellations by you before you have paid in full for your order. Once you have paid for your order in full, we will happily buy-back your bullion product(s) at current buying prices posted on our website.

Payment to The Coin Hunter must be provided using a credit card (via PayPal), Interac e-Tranfer, bank traft or bank wire. Credit card orders for any amounts are reviewed on an order by order basis. Large credit card orders may be subject to additional documentation or screening and are subject to our approval.

You agree that you shall submit full payment within twenty four (24) hours. Such payment must include the full amount owing to us, including but not limited to, payment for the bullion product(s), shipping and handling, and any transaction and/or other fees, as applicable. Should any delays or payment issues be encountered, as happens from time to time, you are required to contact our customer support to inform them of said issues in order to guarantee pricing. Failure to notify us of payment delays could result in cancelling your order and applicable restocking fees being charged.

All payments must be made either in US Dollars or Canadian Dollars as indicated on your order.

Upon our receipt of your payment, in full, we will hold your payment and your bullion product(s) ordered for the clearing time applicable to the method of payment(s) used by you. Once your payment has been verified and upon expiration of the relevant clearing time, your order will be released for shipment to you.

According to Canadian law, at our discretion, we reserve the right to hold and/or cancel any orders that appear to bypass our legal obligation to report FINTRAC eligible transactions. Shipping policy

We aim to ship products listed on our website within ten (10) business days from when we receive payment in full for your order. From time to time, the shipment time of your order may be delayed for reason(s), including but not limited to, reductions in our inventory as a result of increased demand for certain bullion products and/or the reduced supply available to us of same. We will make the best effort to update our website with any delays applicable to particular bullion product as may arise from time to time. When a product or order is subject to a delayed shipping time, this information will be included on our website and your order confirmation email.

We will insure the full value of your shipment to the address provided when your order was placed, or to an address accepted by PayPal. Your signature is required to receive delivery and cannot be waved.

We ship exclusively via either FEDEX Ground or Canada Post Expadited Parcel. All our shipments provide you with tracking information and a delivery signature request. FEDEX will attempt to deliver to your address and obtain either a signed or verbal signature confirmation in person. If unsuccessful, they will re-attempt or request the item be picked up at a FEDEX depot nearest to your location. Fort Canada Post shipments we request “card for pickup” if no “in person” or “lockbox” deliveries are possible. Both CPC and FedEx now often obtain verbal signatures upon delivery and/or pickup. On rare occasions, either can leave the shipment in a location they deem a secure at the delivery address.  We also consider these to be successfully delivered. If you feel that neither a secure pickup or delivery is possible at your location, you may want to consider arranging local pickup at our store. Once the shipment is deemed delivered to your location either by verbal signature, pickup or drop by either Canada Post or FedEx, we can no longer be held liable.

For store pickups, you MUST provide a copy of the original purchase order emailed to you and a valid picture ID to have your order released at the store.

RoR

In addition to all other rights contained in this Agreement, we reserve the following rights unto ourselves to be exercised at our sole discretion:

  • We reserve the right to refuse service to anyone.
  • We reserve the right to hold and/or close online store accounts without notice.
  • We reserve the right to correct any typographical or clerical errors or omissions in any order. We will make a good faith effort to notify you of any such corrections to your order.
  • We reserve the right to cancel any order at any time for any reason. If we exercise this right, we will cancel your order, including the shipment of same, and we will notify you and refund to you all monies you may have paid to us pursuant to such order, less any costs and/or fees associated with cancelling your order, as may be applicable.
  • We reserve the right to change any terms and conditions of sale at any time without any further notice.
  • We hereby reserve the right to involuntarily liquidate, cancel and/or rescind any order where we are unable to successfully obtain and/or to verify a client’s personal information.
  • We reserve the right to hold any payment until it is verified and cleared and/or the customer has communicated with us and submitted a valid Credit Card on all first time orders. This is done solely in the interest of fraud prevention and all holds are removed

 

Privacy

The Coin Hunter does not collect any personal information about individuals except when specifically and knowingly provided by such individuals to create an account and perform transactions with The Coin Hunter Inc, or when required by law or FINTRAC KYC guidelines. To partially fulfill KYC requirements, the online purchase process requires you to provide us with you with a government recognized ID, full name, address, e-mail, phone number and occupation. At times and at our discretion, we may request additional informatiopn such as proof of source of funds, buisness dealings, etc… This information is needed to complete your orders, comply with regulations and to allow The Coin Hunter to contact you should there be a problem with your orders and transactions. The Coin Hunter Inc. processes all it’s credit card paymnets through and external processor (PayPal Inc.), it does not collect and/or hold any credit card information on it’s website. The Coin Hunter Inc, at times, may verbally request Credit Card Information from clients to process fees and deposists through it’s own credit card processor (TD Bank). The Coin Hunter does not share or sell your personal information to any entity unless required by law.

The Coin Hunter Inc. may from time to time send general and promotional information about it’s products. If you wish to unsubscribe from such emails, reply with the word “Unsubscribe” in the subject line and you will be removed from the promotional list.

Cookies

A cookie is a small data file that certain Web sites write to your hard drive when you visit them. A cookie file can contain information such as a user ID that the site uses to track the pages you’ve visited. But the only personal information a cookie can contain is information you supply yourself. A cookie can’t read data off your hard disk or read cookie files created by other sites.

Security

The Coin Hunter Inc takes great care to ensure Customer data is protected against theft, loss, and corruption. We use industry standard secure server (SSL) for transferring any personal and order information. Customer information is made available only to selected employees who require the information to process orders. Our servers are equoped with extensive security features to protect your information. The Coin Hunter Inc is not responsible for any personal information intercepted prior to submission to our servers.

Fintrac Reporting

As a precious metals dealer and legislated by the Government of Canada, we are obligated to report any trasactions we may deem suspicious and/or any cash transactions over $10,000 in cash. We reserve the right to confirm your identity through a government issued ID for ANY purchase amount and ANY form of payment whether the transaction is online or in person at our phisical location. Furthermore, although FINTRAC cash rules apply to periods of 24 hours, we reserve the right to collect personal information for clients who purchase bullion via cash under $10,000 on a regular interval basis.
